The Social Security Administration claims the disability process is non-adversarial. 

 

Nationwide statistics provided by the SSA state that 39 percent of all SSDI applications are approved at the state level by Disability Determination Services (DDS).

The process for obtaining Social Security Disability (SSD) and/or Supplemental Security Income (SSI) benefits is complicated and technical. You do not have to have an advocate/lawyer to assist you with the process.  However, most people who file an application on their own are turned down because they fail to adequately demonstrate that their disabling condition is preventing them from working. Many also make procedural errors because they are unfamiliar with navigating a complicated system.

We get paid according to the law. Currently, under the SSA's fee agreement approval process, it is 25% of the retroactive dollar amount awarded, not to exceed $6,000. Retroactive for SSA means you are paid for the months from the date you claim to be disabled to the time you are approved for benefits.
